Intriguingly enough, as derivative works, fanfiction is protected by copyright law as long as the words and syntax are novel. The author of such a work will not own the pre-existing characters, but they do own the right to the words and syntax, which, for lack of a better term, makes the story. Now then, there are some standards for copyright protection.
